4. TUCSON CODE: AMENDING (CHAPTER 21) PARKS AND RECREATION, ESTABLISHING USER FEES FOR THE EL PUEBLO ACTIVITY CENTER

(b) Ordinance No. 8858 relating to parks & recreation; amending Section 21-14.2 of the Tucson Code, Udall Center Use, to include the El Pueblo Center.
5. PUBLIC HEARING: ZONING - (C9-89-39) Perrillo - Golf Links Road, C-2, CHANGE OF PRELIMINARY DEVELOPMENT PLAN
(a) Report from City Manager APRIL14-97-228 WIV
(b) Hearing for a change of the original development plan for property located at the northwest corner of Golf Links Road and the Pantano Wash. Applicant: David Tannous of the Built Environment, on behalf of the property owner, Family Golf Center. The development proposal is for a seven (7) space baseball batting cage and a "short game" 18-hole golf putting course, on 1.25 acres, in place of the formerly proposed putting and chipping greens. The City Manager recommends the Mayor and Council approve the change of the preliminary development plan in accordance with the plan presented at today’s meeting. The approval is subject to the existing conditions, and the following additional conditions:
17. A 10-foot-wide landscape buffer, including canopy trees planted a maximum of 20 feet apart, shall be installed along the east site boundary adjacent to the future linear park extending from the north boundary of the C-1 parcel to the driving range tee area. Along the south boundary of the development area extending from the parking lot to the linear park boundary (north boundary of the C-1 parcel), canopy trees shall be planted a maximum of 20 feet apart.
18. “Safe by Design” concepts shall be incorporated in the development plan for review by the Tucson Police Department. No access to the linear park is permitted to the private property.
19. The owner/applicant shall dedicate right-of-way for Golf Links Road, per the Major Streets and Routes Plan, if deemed necessary by the City Engineer’s Office.
20. The applicant shall upgrade the unimproved bus stop along the property frontage on Golf Links Road to include a bus shelter, garbage receptacle, and concrete pad. The improvements shall be coordinated with the Department of Transportation, Engineering Division.
(c) Ordinance No. 8861 relating to zoning: Amending certain conditions and the preliminary development plan for property in the vicinity of the northwest corner of Golf Links Road and the Pantano Wash in rezoning case C9-89-39 Perrillo - Golf Links Road.
Twenty-two written approvals and twenty written protests were received at the last public hearing held February 12, 1990. Seventeen protests lie within 150 feet representing a zero (0) percent protest to the north, a fifteen (15) percent protest to the south, a six (6) percent protest to the east, and a three (3) percent protest to the west. Updated protest information, based on this proposal, will be available at the public hearing.
A simple majority vote will be necessary to adopt the subject ordinance.
