4. RECONSIDERATION: TUCSON CODE - AMENDING THE LAND USE CODE RELATING TO APPOINTMENT PROCEDURES AND REQUIREMENTS FOR THE DEVELOPMENT REVIEW BOARD (DRB) (RECONSIDERATION OF ORDINANCE NO. 8961 ADOPTED ON OCTOBER 6, 1997)

(b) Ordinance No. 8961 relating to planning and zoning; amending the Land Use Code (LUC), Article V, Administration, Division 1, Powers and Duties; and specifying an effective date.
The City Manager recommends that the Mayor and Council retain the ordinance adopted on October 6, 1997, and direct staff from Boards and Commissions to maintain contact with the Arizona Builders’ Alliance regarding future DRB appointments.

(b) Report from Zoning Examiner dated October 10, 1997
(c) Request to rezone approximately 0.12 acres located on the west side of 10th Avenue north of Speedway Boulevard. Applicant: Mr. Jack Cotter representing Catholic Community Services. The preliminary development plan is for the conversion of an existing 1,007 square foot residence into offices for Catholic Community Services. The Planning Department and the Zoning Examiner recommend approval of O-3 zoning, subject to certain conditions. The City Manager recommends approval of O-3 zoning, subject to the following conditions.
1. A development plan, in substantial compliance with the preliminary development plan, is to be submitted and approved in accordance with Section 5.3.8 of the LUC.
Four (4) written approvals and zero (0) written protests have been received.2. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials and shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. Enhance the visual appearance of any continuous wall greater than 75 feet in length and 3 feet in height, by varying the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
3. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.
4. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
5. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
A simple majority vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
6. ZONING: (C9-97-05) DENGEL - GOLF LINKS ROAD, RX-1 TO R-1 (NORTH SIDE OF GOLF LINKS ROAD, APPROXIMATELY 125 FEET EAST OF PALM SPRINGS DRIVE)
(a) Report from City Manager NOV3-97-703 WIV
(b) Ordinance No. 8974 relating to zoning: Amending zoning district boundaries in the vicinity of north side of Golf Links Road, approximately 125 feet east of Palm Springs Drive in Case No. C9-97-05 Dengel - Golf Links Road, RX-1 to R-1.
The City Manager recommends that the subject ordinance be adopted.
Seven (7) written approvals and seventeen (17) written protests were received for this case. Ten (10) protests are within the 150 foot notification area, representing a 33.8 percent protest by area to the north, 0 percent to the south, 12.9 percent to the east, and 9.9 percent to the west.
A three-quarter majority vote will be necessary to adopt the subject ordinance.
