6. ZONING: (C9-96-19) ANDALORO - CAMPBELL AVENUE, R-1 TO O-1, REQUEST FOR ONE-YEAR TIME EXTENSION

(b) Request for a one-year time extension for the completion of the conditions of rezoning for the conversion of two existing, one-story single-family residences (total of 3,436 square feet) on two adjacent lots (total of 0.58 acres) for use as professional offices located on the northwest corner of Campbell Avenue and Seneca Street. Applicant: Roy H. Noggle on behalf of the property owner, Dr. Michael Andaloro.
The City Manager recommends the Mayor and Council approve extending the time to complete rezoning conditions for one-year from March 3, 1998, to March 3, 1999, subject to the following conditions and submittal of a development plan in compliance with all conditions and current Code requirements.
1. A development plan, in substantial compliance with the preliminary development plan, and submitted for review and approval in accordance with Section 5.3.8 of the LUC, which includes, but is not limited to: a. Vehicular access to the rezoning site is restricted to a single two-way driveway from Campbell Avenue. All other existing driveways, including the driveway leading to the carport on Seneca Street, shall be removed and replaced with curb to match the existing curb line on Campbell Avenue and Seneca Street. b. No building expansion is permitted and the existing architectural style of the residences shall be retained. Photographs of the existing buildings, along with elevation drawings of the office conversions, shall be submitted with the development plan. c. All required parking and loading areas, landscaping and screening improvements shall be placed on private property and not within the right-of-way of Campbell Avenue or Seneca Street. d. Outdoor lighting shall be shielded, mounted below the height of the screen wall, and directed down away from adjacent residential development. e. If an automated refuse collection system (residential type) is used, pedestrian access to the alley shall include a self-closing, self-locking gate. f. If developed in two phases, all vehicular parking and maneuvering shall be provided as part of the first phase. A separate parking and maneuvering area may be maintained for the residential use during phase one, if the two parking areas are separated by a method approved by the Zoning Administrator. g. Any proposed or required masonry screen walls shall be constructed of or painted with graffiti-resistant materials and incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. The visual appearance of a continuous screen wall greater than 75 feet in length and 3 feet in height, shall be enhanced by varying the wall alignment (jog, curve, notch, or setback, etc.) and plant trees or shrubs in the voids created by the variations. h. No vehicular or pedestrian access for Seneca Street, except for proposed sidewalk in front yard setback area as shown on the preliminary development plan. i. No gates or openings in south screen wall adjacent to Seneca Street and all existing walkways from Seneca Street onto the rezoning site to be eliminated. 2. The owner/applicant shall dedicate right-of-way for Campbell Avenue, per the adopted Major Streets and Routes Plan, and dedicate a 25 foot radius spandrel at the northwest corner of Campbell Avenue and Seneca Street. 3. If freestanding signage is proposed, it shall be shown on the landscape plan and be compatible with the architectural style or theme of the building. 4. If the parcels are not consolidated as one tax code, a recorded joint access and parking agreement shall be required prior to the development plan approval. 5. Incorporate "Safe by Design" concepts in the development plan for review by the Tucson Police Department. 6. The requested O-1 zoning shall be effectuated by a site verification inspection by the Planning Department when it is determined all improvements have been completed in accordance with the requirements of this case. 7. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public. MODIFY 8. The owner/applicant is allowed one-year to March 3, 1999, to comply with all Code requirements and conditions of rezoning. One written approval and two written protests were received for the original public hearing on this case on January 16, 1997. No additional approvals or protests have been received. Both of the protests are within the 150-foot protest area and equate to a protest level of two (2) percent by area to the north and five (5) percent by area to the east.
A simple majority vote will be necessary to approve the time extension, should the Mayor and Council choose to do so.
7. APPEAL: (S-97-18) APPEAL OF SIGN CODE ADVISORY AND APPEALS BOARD DECISION - 549 N. STONE AVENUE

This is an appeal of a decision of the Sign Code Advisory and Appeals Board to deny the variance from the General Requirements and Limitations provisions pertaining to freestanding signs, Sign A: Monument Type sign, (Tucson Code Section 3-59 (D)) which restricts (1) the maximum area, (2) height, and (3) requires a minimum setback from curb to the leading edge of the sign. Specifically, the applicant requested a variance to retain the existing nonconforming freestanding sign without having to bring the sign into conformance with the current Tucson Sign Code. (The existing sign could not be retained, by Code, due to a change of use occurring on the property.)
The applicant is now appealing the Board's decision denying the variance, and requests that the Board's decision be reversed and that a variance be allowed for the placement of one (1) 85 square foot, 36' high freestanding sign, setback 14 feet from the curb to the leading edge of the sign.
The Tucson Sign Code allows a freestanding sign to be 50 square feet in area, maximum height 10 feet, and is required to be setback 20 feet from the existing curb.
It should be noted that even with the variance being denied, the applicant has a right to a conforming freestanding sign in the dimensions and setback described in Section 3-59 (D) of the Sign Code.
