(b) Report from Zoning Examiner dated February 13, 1998
(c) Request to rezone property at the southwest corner of Golf Links Road and Pantano Road. Applicant: CRB Properties, Inc., on behalf of the property owner, Fidelity National Trust No. 10816. The preliminary development plan is for 134 one-story single-family residences using the Residential Cluster Project (RCP) provisions of the Tucson Land Use Code (LUC). The Planning Department and the Zoning Examiner recommend approval of R-2 zoning, subject to conditions. The City Manager recommends approval of R-2, subject to the following conditions.
1. A subdivision plat, in substantial compliance with the preliminary development plan and the Design Compatibility Report dated July 11, 1997, is to be submitted and approved in accordance with Section 5.3.8 of the LUC, including, but not limited to:
a. A maximum of 134 residential units. b. All lots along the south property line adjacent to Sutton Place and Rincon Vista Subdivisions shall be a minimum 7,000 square feet in area. c. The maximum building height for all lots shall be 16 feet measured to the highest point of the roof.
d. A minimum 25-foot building setback for all enclosed portions of the principal structures shall be provided along the south property boundary.
e. A one-foot no-access easement shall be provided along Golf Links Road and Pantano Road, except at street intersections.
f. The exteriors of all buildings shall be earth tone colors.
ADDED g. A minimum twenty-five (25) foot-wide landscape buffer along Golf Links Road and Pantano Road, with twenty (20) feet of the landscape buffer allowed in the future right-of-way, subject to approval by the Office of the City Engineer. The landscape buffer shall be installed and maintained by the homeowners association. ADDED h. A six (6) foot-high masonry wall shall be provided on the south property line, measured from the grade of the adjacent properties. 2. The owner/developer shall make the following dedications:
a. The necessary right-of-way for Golf Links Road, per the Major Streets and Routes Plan.
b. A 30-foot radius spandrel at the southwest corner of Golf Links Road and Pantano Road.
c. A 25-foot radius spandrels at all other street intersections.
3. The owner/developer shall contribute funds to an escrow account to cover the projected improvement districts costs for future pavement, curb, and sidewalk along the Pantano Road frontage of the project.
4. The owner/developer shall provide full improvement along the Marc Drive frontage of the project including pavement, curbs, and sidewalks.
5. The owner/developer shall provide interim improvements to Pantano Road at the two street intersections, if the project is constructed prior to the Pantano Road Widening Project. Modifications to the existing lane striping may be required at the owner/developer's expense to accommodate access to the streets.
6. The owner/developer shall provide full development of a Sun Tran bus stop located at the southeast corner of Marc Drive and Golf Links Road, including a bus shelter complying with the Americans with Disabilities Act (ADA) provisions to the standards of the City of Tucson and Sun Tran.
7. The owner/developer shall dedicate a well site to the City of Tucson, if determined necessary by the Tucson Water Department.
8. Any new street intersecting Pantano Road shall be located at least 200 feet from the centerline of the intersection of Golf Links Road and Pantano Road.
9. A drainage report shall be submitted and approved, including details of retention/detention.
10. All billboards on the site shall be removed prior to approval of the final plat.
11. A "fair disclosure statement" regarding operations at Davis-Monthan Air Force Base shall be provided on all plats and/or development plans.
12. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.
13. All required or proposed masonry screen walls shall be graffiti-resistant. Those visible from a public street shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials and, if continuous for more than 75 feet in length and 3 feet in height, shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
14. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
15. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
Eleven (11) written approvals and eight (8) written protests have been received. Five (5) of the protests are within the 150 foot notification area. The protests generally refer to increased traffic, crime, and setting a trend for higher density. These protests represent a 9.38 percent protest by area to the south and a zero (0) percent protest to the north, west and east.
A simple majority vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
6. ZONING: (C9-97-26) MADERA COUNSELING - ALVERNON WAY, R-3 TO O-1

(c) Request to rezone property at the northwest corner of Third Street and Alvernon Way. Applicant: Joanne Gallaher of Sonoran Studios, Inc. on behalf of the property owners, Janice K. Brundage, Ph.D., doing business as Madera Counseling. The request is to change the use of the existing 2985 square foot counseling office into general professional and/or semi-professional offices. The existing one-story building was converted from a residence to a counseling office by authorization of the Board of Adjustment on January 26, 1994. The Planning Department recommends approval of O-1 zoning subject to conditions and adoption of the subject ordinance. The Zoning Examiner recommends approval O-1 zoning, subject to conditions. The City Manager recommends approval of O-1 zoning subject to the following conditions and adoption of the attached ordinance.
1. A development plan, in substantial compliance with the preliminary development plan and the Design Compatibility Report, is to be submitted and approved including, but not limited to:
a. Preservation of existing vegetation on the site to the greatest extent possible, with special consideration given to the large mesquite trees west of the parking lot.
b. No substantial changes to building footprint or elevations.
2. The owner/developer shall dedicate right-of-way for Alvernon Way per the Major Streets and Routes Plan, including a 25-foot radius spandrel at the northwest corner of Alvernon Way and Third Street.
3. The owner/developer shall record a temporary revocable easement for any "structural" encroachments into the right-of-way of Alvernon Way as dedicated.
4. If the residents on Third Street request a Neighborhood Traffic Management Program to mitigate the impact of through traffic, the owner/developer shall agree to participate in a Neighborhood Management Project and fund the equivalent cost of two speed humps for Third Street.
5. Any existing or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials as needed.
6. "Safe by Design" concepts shall be incorporated into the development plan for review by the Tucson Police Department.
7. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
8. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
(d) Ordinance No. 9027 relating to zoning: Amending zoning district boundaries in the vicinity of the northwest corner of Alvernon Way and 3rd Street in case C9-97-26 Madera Counseling - Alvernon Way, R-3 to O-1.
Four (4) written approvals and three (3) written protests have been received. One (1) protest is located within the 150-foot notification area. This protest represents a 4.66 percent protest by area to the west and a zero (0) percent protest to the north, south and east.
A simple majority vote of the Mayor and Council will be necessary to adopt the subject ordinance should the Mayor and Council choose to do so.
