6. PUBLIC HEARING: ZONING (C9-84-84) RITA RANCH (ANNEXATION AREA 7) - VALENCIA ROAD, O-3 ZONE, REQUEST FOR CHANGE OF CONDITION
(a) Report from City Manager JUNE22-98-361 WIV
(b) Hearing. This is a request to consider a change of condition for a 25 acre parcel located on the south side of Valencia Road approximately 670 feet west of Nexus Road. Applicant: Mr. Frank Bangs of Lewis and Roca on behalf of the property owners, RR Partners. The applicant is requesting that Mayor and Council approve a change to conditions D.2. and D.8., to allow the subject property to be developed as a single-family residential subdivision. Several other conditions have been revised to update them to current language. The Planning Department recommends approval of the change of conditions D.2. and D.8. to allow for the development of single-family residential in the O-3 zone.
The City Manager recommends Mayor and Council approve the change to conditions D.2. and D.8., subject to all other applicable conditions of Ordinance No. 6143 and additional condition H., as follows:

A. An approved landscape and development plan, in accordance with Section
23-409 of the Tucson Zoning5.3.8 of the Tucson Land Use Code.
(1) Recording an acceptable subdivision plat which will provide for dedication of necessary rights-of-way and land for public works facilities (such as streets, drainageways, utilities, and parks).
(2) Recording development-related covenants as determined appropriate by affected City agencies.
(3) Provision of development-related assurances as required by affected City agencies.

Submission of an acceptable "Master Drainage Concept Plan" for the entire Rita Ranch project unless such a study has been approved in writing by the Pima County Flood Control District by the effective date of the annexation of the zoned property to the City of Tucson.(2) Submission of an acceptable drainage report at the time of individual development plan and/or subdivision plat review as determined necessary by the City's Department of Transportation. Such report(s) must be in conformance with the aforementioned "Master Drainage Concept Plan".
(3) Subject only to Master Drainage Concept Plan the resolution of any flooding problems which may exist must be fully in compliance with the City of Tucson Floodplain Regulations.
(4) The banks and beds of all drainageways which are proposed for alteration or improvement shall be stabilized utilizing appropriate/approved structural treatments/methods.
(5) Provision of all-weather access to all lots/parcels proposed for development.
(6) Submission of an acceptable grading plan at the time of individual development plan and/or subdivision plat review demonstrating that appropriate erosion control measures will be included in connection with development.
(7) City of Tucson hydrologic/hydraulic regulations and design standards shall be employed in the preparation of detailed drainage reports/concepts

A suitable arrangement with Pima County Wastewater Management Department, approved by the City of Tucson, regarding sanitary facilities in conformance with policies included in the Pima County Southeast Area Plan, adopted by the Board of Supervisors of Pima County, Arizona, on March 1, 1983.D. Land uses, densities, and road right-of-way alignments shall be consistent with the adopted Pima County Rita Ranch Community Plan, adopted by the Board of Supervisors of Pima County, Arizona, on November 15, 1983, including:

B-2A(R), B-1(R), and R-4(R)C-2(R) and C-1(R) zoned land located on the south side ofLos RealesValencia Road across from Davis-Monthan Air Force Base, there will be constructed a 6 foot high decorative masonry wall.ThisA 6 foot high decorative masonry wall will alsocontinuebe constructed alongLos RealesValencia Road westward to the approximate alignment of Old Vail Road, in conjunction with a 15 foot landscape buffer. The 15-foot landscape buffer shall contain understory shrubs and canopy trees placed twenty (20) foot on-center. There will be breaks in this wall only for major entries to theresidentialnon-commercially zoned landbehindto the south.(3) For the residential property in Rita Ranch, a disclosure statement will appear in the subdivision reports to be filed with the Arizona Real Estate Department. This statement will indicate that said residential property lies between the Approach/Departure Zone of DMAFB and DMAFB itself. The disclosure statement will further indicate the DMAFB is a military installation where governmental approved activities occur which include military training.
(4) With the exception of the 63-acre parcel located adjacent to, and west of, Houghton Road, north of Rita Road, all parcels zoned R-2(R) are limited to a maximum of 8 units per acre.
(5) The 63-acre parcel zoned R-2(R) located adjacent to, and west of Houghton Road, north of Rita Road is limited to a maximum of 12 units per acre.
(6) All parcels zoned R-3(R) are limited to a maximum of 20 units per acre.
(7) All parcels zoned MH(R) are restricted to a maximum of 8 units per acre.

The proximity of DMAFB and sources of noise located on DMAFB, including small arms range and ordinance disposal activities, shall be disclosed to prospective purchasers in sales agreements, in subdivision reports filed with the Arizona Real Estate Department, on the final plat and specifically identified at the time of closing.
h. Deceleration lanes, as approved by the Tucson Department of Transportation, shall be constructed on Valencia Road for entrances to the subject property.
i. Security fencing, as approved by DMAFB, shall be installed along the south side of the Base parcel (approximately 4,000 feet).
(9) That parcel zoned I-2(R) located west of Rita Road, north of the Southern Pacific Railroad, which was the subject of the approved Pima County zoning case Co9-84-29, ARIES Enterprises, Ltd. shall, in addition, be subject to the following:
a. No more than one (1) parcel split; and
b. Any other applicable requirements as established in Pima County zoning case C09-84-39.

Provision/construction of on and off-site public works improvements/facilities as determined necessary by appropriate/affected City and County agencies.F. Participation in improvement districts formed for the purpose of constructing or maintaining public facilities/improvements if/as deemed necessary by appropriate City agencies.
G. As they relate to site specific development plans, standard City of Tucson policies/regulations/requirements, as they relate to the provision/construction of public works facilities/improvements shall govern the design and installation of such facilities within the Rita Ranch project (including but not limited to the Major Streets and Routes Plan; Street Development Standards; water use restrictions/conservation policies; codes/ordinances, etc ).
NEW
H. Additional conditions applicable to the 25-acre property zoned O-3.
1. The owner/developer shall dedicate right-of-way for Valencia Road per the Major Streets and Routes Plan (MS&R).
2. The owner/developer shall provide additional roadway improvements to Valencia Road as required by the Office of the City Engineer including:
a. Curb and sidewalk along the Valencia Road frontage of the property.
b. Additional Valencia Road pavement to accommodate eastbound acceleration and deceleration lanes and westbound left turn lanes at all access points.
3. A hydrology report in conformance with the Rita Ranch Master Drainage Report.
4. The owner/developer shall dedicate a well site to the City of Tucson, if determined necessary by the Tucson Water Department.
5. All required or proposed masonry screen walls shall be graffiti-resistant. Those visible from a public street shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials and, if continuous for more than 75 feet in length and 3 feet in height, shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
6. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.
7. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
(c) Ordinance No. 9079 relating to zoning: Amending certain conditions for property zoned O-3 in the vicinity of the south side of Valencia Road approximately 670 feet west of Nexus Road in the Rita Ranch (Area 7 Annexation) Case No. C9-84-84.
The Rita Ranch Neighborhood Association met on May 28, 1998, and voted 144 to 33 to support the request to develop single-family residential.
A simple majority vote will be necessary to approve the requested change of conditions.
7. PUBLIC HEARING: ZONING (C9-89-02) PARK MALL - BROADWAY BOULEVARD, C-1, C-2, C-3, P AND R-1 ZONES, CHANGE OF APPROVED DEVELOPMENT PLAN (REF. C9-96-61 AND C9-63-38)(CONTINUED FROM THE MEETING OF JUNE 8, 1998)
(a) Report from City Manager JUNE22-98-344 WIV
(b) Hearing. This is a request to consider a change of development plan for previously approved rezoning case. Applicant: David Evans and Associates on behalf of the property owners, General Growth Management of California. The development plan is for the Park Mall Shopping Center at 5870 E. Broadway Boulevard. The revised development plan proposes expanding the Mall from 850,000 square feet to 1,307,470 square feet, adding three (3) additional out-parcels with a total of 38,000 square feet and two (2) above grade parking structures and an eleven acre surface parking area. The total gross floor area will be 1,362,640 square feet. The site is located on the south side of Broadway Boulevard west of Wilmot Road. The Planning Department recommends approval of the proposed revisions to the Park Mall development plan, subject to the conditions.
The City Manager recommends approval of the revisions to the Park Mall development plan, subject to the following conditions:
1. A development Plan submitted for approval in accordance with Section 5.3.8. of the Tucson Land Use Code, in substantial compliance with the preliminary development plan dated March 31, 1998, and the preliminary landscape development plan dated March 30, 1998, and the revised elevation plan, including, but not limited to:
a. Compliance with the General Design and Buffering Policies of the Broadway-Craycroft Area Plan, including attention to the siting and buffering of the proposed three level garage.
b. The parking garages shall be designed to screen both building security lights and vehicular headlights from adjoining neighborhoods.
c. A traffic control design and/or device is to be installed at the intersection of Broadway Boulevard and the northwest drive that will minimize the ability for Mall generated vehicles to access the adjoining neighborhood.
2. The owner/developer shall fund and install the following transportation improvements:

a.TheTraffic signal improvements at the intersections of Broadway/Indian House and/or Broadway/Chantilly in conformance with the General Design Criteria of the adopted Roadway Development Policies. The exact improvements are to be determined based on further study by the Department of Transportation and the developer.serving Park Mall at Indian House Road be relocated to the Chantilly alignment. The existing traffic signal be converted to a "Pelican"-type pedestrian traffic signal.b. A new traffic signal and approach lighting be installed at Wilmot Road and the Park Mall ring road, including all required geometric improvements needed to maximize the effectiveness of the signal operation for the new intersection and the area-wide signal system.
c. Due to the need to maintain quality progression along the major roadways, the developer shall install state-of-the-art video vehicle detection equipment to upgrade the Broadway Boulevard/Wilmot Road intersection.

d. The enhanced transit facility shall be centrally located and in close proximity to the Broadway Boulevard/Indian House intersection, and shall include a bus pull-out, shelters, and landscaping.The existing vehicular access at this point shall be closed or narrowed to enhance pedestrian facilities.e. A traffic study shall be submitted that analyzes all impacts to existing roadways, including median openings, left turn storage, and neighborhood impacts caused by the expansion of the Mall.
f. Pedestrian connections shall be shown on the plans connecting the Mall to all public streets and out parcels.

g. The ring road shall be constructed to a minimum of a 5 lane cross-section atfromWilmot Roadto the Dillards’ parking structureand at4 lanes from that point west toBroadway Boulevard (if a traffic signal is installed at Broadway) and transitioning to a three lane cross-section throughout the remainder of the ring road. Bicycle facilities should be considered along the ring road to enhance their use. Bike detection and bike lanes will be required at anythenew traffic signalizedintersections.3. A drainage report, addressing detention and retention for the "new" portions of the development, is required.
4. A Letter of Map Revision (LOMR) is required for any modifications to the existing floodplain on the site.
5. Noise-generating uses, such as loading zones and dumpsters locations, shall be located a minimum of fifty (50) feet from any adjacent residential zone boundary. Outdoor loudspeakers shall be directed away from adjacent residential zoning.
6. Incorporate "Safe by Design" concepts in the development plan, as recommended by the Tucson Police Department.
7. All new lighting shall be directed downward and away from any adjacent residential uses or residentially zoned areas.
8. Any new masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. All new masonry walls shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials.
9. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public.
All property owners within 300 feet of this request were notified in writing of the request to revise the Park Mall development plan. No written comments have been received by staff.
A simple majority vote will be necessary for the Mayor and Council to approve the proposed revisions to the Park Mall development plan.
