A liquor license application will automatically be removed from the Consent Agenda and considered as a separate item by the Mayor and Council if either of the following occurs: A protest against a liquor license application has been received by the City Clerk; OR, A City staff report recommends denial of a liquor license application.
4. ZONING: (C9-98-19) AUTHENTIC WEST - ESCALANTE ROAD, SR TO RX-2
(a) Report from City Manager SEPT14-98-495 WIV
(b) Report from Zoning Examiner dated August 21, 1998
(c) Request to rezone approximately 3.91 acres from SR to RX-2 zoning. The rezoning site is located on the north side of Escalante Road approximately 1,275 feet west of Houghton Road. Applicant: Mr. Frank Koski of Ryan Architects and Engineers, Inc., on behalf of the property owners, Authentic West. The preliminary development plan is for five one-story single-family residences for a density of 1.28 units per acre. The Planning Department and Zoning Examiner recommend approval of RX-2 zoning, subject to certain conditions. The City Manager recommends approval of RX-2 zoning, subject to the following conditions.
1. A subdivision plat, in substantial compliance with the preliminary development plan and the Environmental Resource Report, is to be submitted and approved in accordance with Section 4.1.1 of the LUC, including, but not limited to:
a. At least 30 percent of the rezoning site, including all of the floodplain of the Escalante Wash, shall be designated as Natural Undisturbed Open Space. It shall be so designated in a surveyable manner on the tentative and final plats and referred to in the CC&Rs.
b. A maximum building height of 14 feet.
2. The owner/developer shall dedicate an additional 15 feet of right-of-way for Escalante Road along the frontage (to provide a 45-foot north half right-of-way).
3. The owner/developer shall install additional pavement, curb and sidewalk along the Escalante Road frontage of the property consistent with the improvements that were approved for the development to the immediate east, including a turn-around if determined to be necessary by the Tucson Department of Transportation.
4. The owner/developer shall install sidewalk along the Domenic Lane frontage of the site. If additional right-of-way is required to accommodate the sidewalk in the standard location, the owner/developer shall dedicate the needed right-of-way.
5. A drainage report shall be submitted for review and approval.
6. The U. S. Fish and Wildlife Service (USFWS) guidelines regarding the Cactus Ferruginous Pygmy Owl shall be followed.
7. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls visible from the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. In addition, any continuous wall greater than 75 feet in length and 3 feet in height shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
8. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.
9. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
10. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
Seven (7) written approvals and three (3) written protests have been received. One (1) of the protests is located within the 150 foot notification area and results in a five (5) percent protest by area to the east, and zero (0) percent protest to the north, south and west.
A simple majority vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
5. ZONING: (C9-98-20) SAVAGE - CRAYCROFT ROAD, R-1 TO O-1
(a) Report from City Manager SEPT14-98-496 WVI
(b) Report from Zoning Examiner dated August 21, 1998
(c) Request to rezone approximately 0.29 acres from R-1 to O-1 zoning. The rezoning site is located on the east side of Craycroft Road approximately 500 feet north of Pima Street. Applicant: Mr. Mark Savage on behalf of the property owners, Mark and Donna Savage and Helen Savage. The preliminary development plan is for the conversion of an existing 2,000 square-foot, one-story, single-family residence on a 12,612 square-foot lot (approximately 0.29 acres) into a professional office. The Planning Department recommends approval of O-1 zoning and adoption of the ordinance presented, subject to certain conditions. The Zoning Examiner recommends approval of O-1 zoning, subject to certain conditions. The City Manager recommends approval of O-1 zoning and adoption of the ordinance presented, subject to the following conditions.
1. A development plan, in substantial compliance with the preliminary development plan and the Design Compatibility Report, is to be submitted and approved in accordance with Section 5.3.8 of the LUC, including, but not limited to:
a. Canopy trees shall be planted along the perimeter walls at a density of one (1) tree per twenty-five (25) feet of wall.
b. Decorative materials, visible on the adjacent property, shall be added to the east, north, and south walls. A wall elevation and color palette shall be submitted as part of the development plan.
c. Landscaped areas shall be designed to utilized water harvesting techniques.
2. The owner/developer shall dedicate right-of-way for Craycroft Road per the Major Streets and Routes Plan.
3. Freestanding signage for this development shall be limited to one (1) sign with a maximum of two (2) sign faces, a maximum of 30 square feet per sign face, and a maximum sign height of eight (8) feet. Freestanding signage shall be designed of the same materials and colors as the building and walls, and shall be integrated into the landscape buffer area.
4. All exterior lighting shall be low sodium and shall be directed down and away from adjacent residential properties.
5. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.
6. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
7. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
(d) Ordinance No. 9119 relating to zoning: Amending zoning district boundaries in the vicinity of the east side of Craycroft Road approximately 500 feet north of Pima Street in case C9-98-20 Savage - Craycroft Road, R-1 to O-1.
Four (4) written approvals and one (1) written protest have been received. The one protest is located outside of the 150 foot notification area.
A simple majority vote of the Mayor and Council will be necessary to adopt the ordinance presented, should the Mayor and Council choose to do so.
6. PUBLIC HEARING: ZONING (C9-82-39) CARDINAL - MAIN AVENUE, O-3 ZONE (EL PRESIDIO HISTORIC DISTRICT) CHANGE OF DEVELOPMENT PLAN
(a) Report from City Manager SEPT14-98-494 WI
(b) Request to consider a change of development plan for a previously approved rezoning case for a site located on the west side of Main Avenue approximately 300 to 370 feet south of Franklin Street in the El Presidio Historic District. The current use of the property is the Arizona State Lands Department Offices and a residential component in the same building. Applicant: Mr. Robert Bailey on behalf of the property owner, Mr. Charles Cardinal. The revised development plan proposes expanding the office use within the main structure and constructing a new separate residential and office structure to the west of the existing historic structure. The Planning Department recommends denial of the proposed revisions to the development plan. Should the Mayor and Council choose to approve the request, it is recommended that the approval be subject to certain conditions. The City Manager recommends denial of the proposed revisions to the development plan. Should the Mayor and Council choose to approve the request, it is recommended that the approval be subject to the following conditions:
1. All required parking spaces to be provided per the requirements of the LUC.
2. All new lighting shall be directed downward and away from any adjacent residential uses.
3. Any new masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials.
4. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public.
All property owners within 300 feet of this request were notified in writing of the request to revise the development plan and the date and time of the public hearing. The original rezoning case in 1984 received seven (7) written protests and zero (0) written approvals. The protests did not constitute a twenty percent protest in any of the four quadrants. Therefore, a simple majority vote of the Mayor and Council was originally required to adopt the ordinance.
A simple majority vote will be necessary for the Mayor and Council to approve the proposed revisions to the development plan.
