4. ZONING: (C9-97-22) FIDELITY NATIONAL TRUST 10816 - GOLF LINKS ROAD, RX-1, R-1 AND C-1 TO R-2, ORDINANCE ADOPTION
(a) Report from City Manager JAN4-99-5 WIV
(b) Ordinance No. 9184 relating to zoning: Amending zoning district boundaries in the vicinity of the southwest corner of Golf Links Road and Pantano Road in case C9-97-22 Fidelity National Trust 10816 - Golf Links Road, RX-1, R-1 and C-1 to R-2.
The City Manager recommends that the subject ordinance be adopted.
Eleven (11) written approvals and eight (8) written protests were received for this case. Five (5) protests are located within the 150 foot notification area, representing a 9.38 percent protest by area to the south and a zero (0) percent to the north, east and west.
A simple majority vote will be necessary to adopt the subject ordinance.
5. ZONING: (C9-98-27) LONG - FAIRVIEW AVENUE, MH-1 TO C-1, ZONING EXAMINER'S REPORT (CONTINUED FROM THE MEETING OF DECEMBER 14, 1998)

(c) Request to rezone approximately 0.29 acres of a 0.74 acre parcel from MH-1 to C-1 zoning. The applicant is Mr. Carl Winters of Planning Resources, on behalf of the property owner, Mr. Clinton Long. The rezoning site is located on the east side of Fairview Avenue approximately 150 feet north of Prince Road. The southern 0.45 acre portion of the parcel is currently zoned C-1 and has frontage on both Prince Road and Fairview Avenue. The preliminary development plan is to develop a 9,000 square-foot one-story multi-tenant commercial building on the entire parcel. The Planning Department and Zoning Examiner recommend approval of C-1 zoning, subject to certain conditions. The City Manager recommends approval of C-1 zoning, subject to the following conditions.
1. A development plan, in substantial compliance with the preliminary development plan and the Design Capability Report, is to be submitted and approved in accordance with the requirements of the Tucson Land Use Code including, but not limited to:
a. A six (6) foot masonry wall to be provided adjacent to the north and east property lines.
b. Canopy trees to be provided along the north and east property lines at a ratio of one tree per 33 linear feet.
c. Loading spaces, dumpsters, mechanical equipment (other than passive solar) and other noise or odor producing uses shall be located at least fifty (50) feet from the north and east property lines, unless a lesser distance is approved in writing by the adjacent property owner(s).
d. Any roof mounted mechanical equipment must be screened from adjacent residential development.
2. The owner/developer shall dedicate right-of-way as necessary to comply with the requirements of the Major Street and Routes Plan.
3. The owner/developer shall construct all required public sidewalks and close all unused curb cuts.
4. The owner/developer shall develop a Sun Tran bus stop, including bus shelter, on the northeast corner of Prince Road and Fairview Avenue, if required by the Department of Transportation.
5. A drainage report shall be submitted for review and approval, including details of retention/detention.
6. All lighting shall be shielded and directed away from adjacent residences and mounted as close to the ground as possible.
7. Signage shall be integrated into the project utilizing colors and materials similar to those used in the building design.
8. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls visible from the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. In addition, any continuous wall adjacent to a public right-of-way that is greater than 75 feet in length and 3 feet in height shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
9. An on-the-ground archeological survey shall be performed, if required by the Arizona State Museum.
10. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.
11. Any relocation, modification, etc., of existing utilities and/or public improvements, including modification of the traffic signal or street lighting, necessitated by the proposed development shall be at no expense to the public.
12. Issuance of a building permit for construction of the proposed development based on an approved development plan in compliance with all Code requirements and conditions of rezoning by January 4, 2004.
Four (4) written approvals and one (1) written protest have been received. The one protest is located outside of the 150 foot notification area.
A simple majority vote will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
6. ZONING: (C9-98-28) U. S. HOME - HOUGHTON ROAD, SR, RX-2, AND O-3 TO R-1, ZONING EXAMINER'S REPORT
(a) Report from City Manager JAN4-99-21 WII
(b) Report from Zoning Examiner dated December 4, 1998
(c) Request to rezone approximately 28.4 acres from SR, RX-2, and O-3 to R-1 zoning. The rezoning site is located west of Houghton Road and north of 22nd Street. The applicant is Mr. Gordon Stone of Cella Barr Associates, on behalf of the developer, U. S. Home Corporation. The preliminary development plan is for an 89 lot single-family subdivision utilizing the Residential Cluster Project (RCP) provisions of the Land Use Code (LUC) for a density of 3.13 units per acre. The Planning Department and Zoning Examiner recommend approval of R-1 zoning, subject to certain conditions. The City Manager recommends approval of R-1 zoning, subject to the following conditions.
1. A subdivision plat, in substantial compliance with the preliminary development plan and the Environmental Resource Report and Design Compatibility Report, is to be submitted for approval in accordance with the requirements of the Tucson Land Use Code including, but not limited to:
a. A pedestrian connection shall be provided between the west residential section and the C-1 parcel.
b. The 100-year floodplain of the Este Wash shall remain undisturbed.
c. The height of the dwelling units along Leland Drive and the north property line adjacent to McCalester Park subdivision shall be one-story, not to exceed 19 feet as measured to the top of the roof.
d. All dwellings shall be stuccoed, utilize earthtone colors, and have ground-mounted mechanical equipment.
e. No vehicular access to Leland Drive.
f. A five foot high masonry wall and a ten foot wide landscape buffer along the north property line adjacent to McCalester Park subdivision.
g. A five foot high masonry wall along Leland Drive in compliance with Condition No. 11 design guideline.
2. The owner/developer shall dedicate 35 feet of right-of-way along 22nd Street and 25 feet of right-of-way along Houghton Road per the Major Streets and Routes Plan.
3. The owner/developer shall install southbound and westbound right turn lanes on Houghton Road and 22nd Street respectively. Additional pavement shall also be placed on Houghton Road to provide a left turn lane into the rezoning site. If bike lanes exist at the time of development, they shall be retained and the left turn lane provided on added pavement.
4. The owner/developer shall install curb and sidewalk along the Houghton Road and 22nd Street frontages of the site.
5. A drainage report shall be submitted for review and approval, including details of retention/detention.
6. The 100-year floodplain of the Este Wash shall be preserved in its natural state.
7. The owner/developer shall provide for a pedestrian trail along the banks of the Este Wash which may be extended to Case Park. The dimensions of the trail shall be based on the requirements of the City of Tucson Parks and Recreation Department.
8. The boundaries of the 100-year floodplain, and trail if located outside of the 100-year floodplain, shall be fenced prior to any grubbing, or grading, or other ground disturbing activities to prevent encroachment into the floodplain. The fencing shall remain in place until the conclusion of the project.
9. The U. S. Fish and Wildlife Service guidelines regarding the Cactus Ferruginous Pygmy Owl shall be followed.
10. The Arizona Game and Fish Department guidelines regarding raptors, bats, gila monsters, and special status plants and animals shall be followed.

Zero (0) written approvals and seven (7) written protests have been received. Six (6) protests are located within the 150 foot notification area and result in a 5.1 percent protest by area to the north, a 13.3 percent protest to the west and a 0.0 percent protest to the south and east.
A simple majority vote will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
7. ZONING: (C9-96-19) ANDALORO - CAMPBELL AVENUE, R-1 TO O-1, ORDINANCE ADOPTION

(b) Ordinance No. 9188 relating to zoning: Amending zoning district boundaries in the vicinity of the northwest corner of Campbell Avenue and Seneca Street in case C9-96-19 Andaloro - Campbell Avenue.
The City Manager recommends that the subject ordinance be adopted.
One (1) written approval and two (2) written protests were received for this case. Two (2) protests are located within the 150 foot notification area, representing a two (2) percent protest by area to the south, a five (5) percent protest to the east, and a zero (0) percent protest to the north and west.
A simple majority vote will be necessary to adopt the subject ordinance.
8. AGREEMENT RENEWAL: WITH THE ARIZONA WATER BANKING AUTHORITY FOR THE STORAGE OF CENTRAL ARIZONA PROJECT WATER AT THE CENTRAL AVRA VALLEY STORAGE AND RECOVERY PROJECT
