6. SPECIAL EXCEPTION LAND USE PUBLIC HEARING: APPEAL OF ZONING EXAMINER'S DECISION, TUCSON ELECTRIC POWER COMPANY - 3505 EAST BROADWAY BOULEVARD, R-1 ZONE (SE-98-32)

(b) Hearing on an appeal of the Zoning Examiner's decision to approve a Special Exception Land Use request for the expansion of an existing electrical substation at 3505 E. Broadway Boulevard located on El Con Mall property. The Special Exception Land Use request is from Mr. Duane Bock on behalf of Tucson Electric Power Company. The appeal to the Mayor and Council is from Mr. Leo Pilachowski, a party of record in this matter and an adjacent property owner.
The Special Exception Land Use request is to allow the reconstruction and expansion of an electric substation which serves the El Con Mall and surrounding neighborhoods. The site is located south of the El Conquistador Estates Subdivision, east of the El Encanto Subdivision, west of the El Montevideo Subdivision, and north of El Con Mall, but within the northernmost parking lot, approximately 1,600 feet north of Broadway Boulevard. The preliminary development plan is for the expansion of the existing electric substation from 2,726 to 5,670 square feet within a 11,543 square-foot easement. The portion of the El Con Mall property on which the substation is located is zoned R-1.
An electrical substation is identified as a Utilities: Distribution System use in the Tucson Land Use Code (LUC) and requires approval through a Type V Administrative procedure (Section 5.4.3.5) when located in a residential zone. This process requires a public hearing before the Zoning Examiner after which a decision is rendered to approve the use with or without conditions or to deny the use.
The Planning Department recommended in the report dated December 17, 1998, that the Zoning Examiner approve the Special Exception Land Use request for the expansion of the existing electrical substation, subject to certain conditions. The Zoning Examiner held a public hearing on December 17, 1998. The Examiner approved the Special Exception Land Use request for the expansion of an existing electrical substation, subject to staff's recommended conditions. The City Manager recommends the Mayor and Council uphold the Zoning Examiner's decision to approve the Special Exception Land Use request for the expansion of an existing electrical substation, subject to the following conditions as recommended by the Zoning Examiner:
1. A Site Plan, in substantial compliance with the preliminary development plan, shall be submitted for review and approval including, but not limited to, the following:
a. Australian Willow (Geijera parvifolia) shall be replaced with a species on the Drought Tolerant Plant list that meets the needs of the neighborhood and TEP.
b. The new walls shall be a desert earthtone (not gray) and compatible with the design and character of the existing screening.
2. The overall easement to Tucson Electric Power Company shall be increased to include all proposed landscaping surrounding the substation.
3. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials.
4. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.
5. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public.
Seven (7) written approvals and forty (40) written protests have been received.
