4. APPEAL: (S-99-19) APPEAL OF SIGN CODE ADVISORY AND APPEALS BOARD DECISION - 1301 W. AJO WAY, LANE PETROLEUM CHEVRON (CITY APPEAL NO. S-99-001)

(b) Applicant/Appellant: Mr. Robert Fiscus of RFA, Inc., representing Lane Petroleum Chevron
This is an appeal of a decision of the Sign Code Advisory and Appeals Board to deny a variance request to (1) exceed the sign area of a freestanding sign by 114 square feet and (2) exceed the height of a freestanding sign by 90 feet. The requested variance would allowed for the placement of one 164 square foot, 100 foot freestanding sign.
The Board found that there were no exceptional circumstances applicable to the property, and strict enforcement of the regulations would not deprive the property of privileges enjoyed by other property in the same district.
The applicant is now appealing the Board's decision to the Mayor and Council.
The City Manager recommends that the Mayor and Council consider the merits of the appeal and vote to uphold, reverse or modify the decision of the Board.
