(b) Resolution No. 18291 relating to water; authorizing and approving the execution of the first amendment to the Sabino Springs Water Reservoir Agreement.
5. ZONING: (C9-89-20) ESTES - VALENCIA ROAD, O-3 TO C-1, ORDINANCE ADOPTION
(a) Report from City Manager MAY17-99-237 WI
(b) Request to rezone a portion of the property west of Commerce Court Road approximately 360 feet north of Valencia Road, from O-3 to C-1. Applicant: Rick Engineering, on behalf of the property owner, Valencia - Midvale L.L.C. The development plan is for the Midvale/Valencia Retail Center. The rezoning request is for lots 8 and 9 located in the northeast corner of the proposed development. The remainder of the site is currently zoned C-1. The Planning Department recommends adoption of the ordinance presented. The City Manager recommends adoption of the ordinance presented.
(c) Ordinance No. 9228 relating to zoning: Amending zoning district boundaries in the vicinity of the west side of Commerce Court Road approximately 360 feet north of Valencia Road in rezoning case C9-89-20 Estes - Valencia Road, O-3 to C-1.
One (1) written approval and zero (0) written protests were received for this case.
A simple majority vote of the Mayor and Council will be necessary to adopt the ordinance presented.

7. REAL PROPERTY: SALE OF A PERPETUAL RAILROAD EASEMENT TO UNION PACIFIC FOR RAILROAD PURPOSES OVER FIRST AVENUE RIGHT-OF-WAY IN RELATION TO THE SOUTH YARD DRILL TRACK REDEVELOPMENT PROJECT
(a) Report from City Manager MAY17-99-242 WI, WV & WVI
(b) Ordinance No. 9231 relating to real property; authorizing and approving the sale of a perpetual railroad easement to the Union Pacific Railroad.
The City Manager recommends that Mayor and Council:
1. Approve Ordinance No. 9231 authorizing the conveyance of an easement to Union Pacific Railroad for the section of First Avenue so described;
2. Require the inclusion of nine (9) rail crossing agreements located throughout the community for the I-net Project in the contract for First Avenue rights-of-way at no additional cost to the City of Tucson; and
3. Direct staff to implement an appropriate master planning effort to develop guiding principles to be employed in the development of the South Yard Drill Track and its environs.
