    (c) This is a request to rezone approximately 2.14 acres of property, located on the south side of River Road approximately 1,300 feet west of Campbell Avenue, from R-3 to O-3. Applicant: Ms. Christina Clark of Gromatsky Dupree and Associates, on behalf of the property owner, River Road LLC. The preliminary development plan is for approximately 20,000 square-foot of office building on the 2.14 acre site. The Planning Department recommends approval of O-3 zoning and adoption of the ordinance presented, subject to certain conditions. The Zoning Examiner recommends approval of O-3 zoning, subject to certain conditions. The City Manager recommends approval of O-3 zoning and adoption of the ordinance presented, subject to the following conditions.

      1. A development plan, in substantial compliance with the revised preliminary development plan and the Design Compatibility Report, is to be submitted for review and approval in accordance with Section 5.3.8 of the LUC including, but not limited to:

        a. A pedestrian link, in coordination with the Post Office, between the proposed office complex and the adjacent Post Office use. The route shall be approved by the Tucson Police Department for compliance with "Safe by Design" concepts.

        b. All new development shall utilize earthtone colors and materials. Brighter colors may be used as accents as permitted by the Scenic Corridor Zone regulations.

      2. The owner/developer shall dedicate, or verify the existence of, appropriate right-of-way on River Road per the Major Streets and Routes Plan map.

      3. The owner/developer shall provide eastbound deceleration/acceleration lanes on River Road for any proposed driveway opening if not provided as part of the Pima County Roadway project.

      4. If River Road is not reconstructed by Pima County as part of a Pima County Bond Program and the City eventually constructs the project as an improvement district, the owner/developer agrees to support such an improvement district and accept such assessments that would typically be levied against the property.

      5. An adequate drainage easement shall be provided along the western property line to accommodate off site flows draining across or under River Road. The width of the public access easement along the wash shall be at least sixteen (16) feet. Vehicular access to the easement will be provided at three locations designed as swale inlets. Bollards with a chain will be provided across the access points.

      6. Prior to the development plan approval, the proposed improvements to the tributary wash located along the full length of the western boundary of the site shall be reviewed and approved by the City of Tucson Departments of Transportation and Parks and Recreation for compatibility with possible future foot, horse, mountain bike, and road bike trail as recommended by the Eastern Pima County Trails Master Plan.

      7. A drainage report shall be submitted for review and approval, including retention/detention calculations/requirements for the entire 6.7 acre site.

      8. Water harvesting techniques shall be utilized by conveying rooftop, parking area access lane (PAAL), and parking area drainage to designated water harvesting areas.

      9. Architecturally detailed building elevations for the proposed office buildings next to existing residential development shall be provided to determine that the privacy of the residential units has been maintained.

      10. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls adjacent to the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials.

      11. All outdoor lighting shall be directed down and away from residential parcels and public roadways and be as low in elevation as possible.

      12. All new dumpsters and loading spaces shall be placed at least fifty (50) feet from residentially zoned or developed property.

      13. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

      14. The Arizona Game and Fish Department guidelines regarding raptors, bats, gila monsters, and special status plants and animals shall be followed.

      15. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.

      16. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.

      17. Compliance with all Code requirements and conditions of rezoning by June 19, 2005.

    (d) Ordinance No. 9406 relating to zoning: Amending zoning district boundaries in the vicinity of the south side of River Road approximately 1,300 feet west of Campbell Avenue in Case C9-00-09 River Road LLC - River Road, R-3 to O-3.

    Zero (0) written approvals and zero (0) written protests have been received.

    A simple majority vote of the Mayor and Council will be necessary to approve the ordinance presented, should the Mayor ad Council choose to do so.

6. TUCSON CODE: AMENDING (CHAPTER 27) RELATING TO MODIFICATIONS TO THE WATER WASTE ORDINANCE
