4. ZONING: (C9-00-18) WILMOT OFFICE VENTURES LLC – WILMOT ROAD, R-2, R-3 AND C-2 TO O-2, ZONING EXAMINER’S REPORT

  1. The owner/developer shall provide a six (6)-foot wide sidewalk along the entire frontage of Wilmot Road along with any necessary curb access ramps at all driveway side streets.

  2. A drainage report shall be submitted for review and approval, including retention/detention calculations/requirements.

  3. Water harvesting techniques shall be utilized by conveying rooftop, parking area access lane (PAAL), and parking area drainage to designated water harvesting areas.

  4. The existing billboard shall be removed before the issuance of any building permits.

  5. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls adjacent to the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. In addition, any continuous wall greater than 75 feet in length and 3 feet in height shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.

  6. All outdoor lighting shall be directed down and away from residential parcels and public roadways and be as low in elevation as possible.

  7. All new dumpsters and loading spaces shall be placed at least fifty (50) feet from residentially zoned or developed property.

  8. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

  9. All areas identified as natural or undisturbed open space shall be fenced off and protected prior to any on-site development activity.

  10. The U. S. Fish and Wildlife Service guidelines regarding the Cactus Ferruginous Pygmy Owl shall be followed.

  11. The Arizona Game and Fish Department guidelines regarding raptors, bats, gila monsters, and special status plants and animals shall be followed.

  12. Documentation shall be provided that the apartments to the south have their required parking without the parking shown on the survey on the rezoning site.

  13. Signage shall be compatible with the landscape plan and reflect the architectural style of the development.

  14. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.

  15. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.

  16. Five years allowed to comply with all Code requirements and conditions of rezoning.

    Three (3) written approvals and zero (0) protests have been received.

    A simple majority vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.

    5. ZONING: (C9-00-19) TUCSON MEDICAL CENTER – WILMOT ROAD, R-1 AND R-3 TO O-3, ZONING EXAMINER'S REPORT

    (a) Report from City Manager SEPT18-00-536 WVI

    (b) Report from Zoning Examiner dated August 18, 2000.

    (c) Request to rezone approximately 7.51 acres of property located on the northwest corner of Fifth Street and Wilmot Road, from R-1 and R-3 to O-3 zoning. Applicant: Michael Grassinger of the Planning Center on behalf of the property owners, Tucson Medical Center. The preliminary development plan is for two, two-story office buildings with a total floor area of approximately 104,000 square feet. The Planning Department and Zoning Examiner recommend approval of O-3 zoning, subject to certain conditions. The City Manager recommends approval of O-3 zoning, subject to the following conditions.

    1. A development plan, in substantial compliance with the Preliminary Development Plan and Design Compatibility Report, is to be submitted for review and approval in accordance with Section 5.3.8 of the LUC, including, but not limited to:

      1. A maximum building height of two (2) stories.

      2. No vehicular access to Fourth Street. A one-foot no-access easement shall be recorded along the north and west property lines. This condition shall not apply if Fourth Street is closed between the rezoning site and the neighborhood to the west.

      3. No balconies or non-clerestory windows on the second floor facing the west without neighborhood review as detailed in condition 14, below.

      4. No buildings (other than carports) closer than one hundred fifty (150) feet of the west property line.

      5. A minimum five (5) foot high decorative masonry wall and canopy trees at a density of at least one (1) per thirty-three (33) linear feet east of the access/maintenance easement.

      6. Canopy trees, an average of twenty-five (25) feet apart, on both sides of the centralized PAAL (parking area access lane) from Fifth Street. No parking spaces shall back into that PAAL.

      1. The owner/developer shall dedicate right-of-way, per the Major Streets and Routes Plan, along Wilmot Road and Fifth Street as required.

      2. The owner/developer shall provide a southbound right turn deceleration lane on Wilmot Road for the proposed northern most access driveway located where the median has an opening.

      3. The owner/developer shall construct a southbound right turn bay at the intersection of Wilmot Road and Fifth Street.

      4. The owner/developer shall widen Fifth Street west of the access opening to provide a left turn storage lane and transition taper for eastbound motorists entering into the site.

      5. The owner/developer shall provide a recessed Sun Tran pull out bus bay with shelter on Fifth Street west of the traffic signal.

      6. The owner/developer shall provide the necessary modifications/relocations to the traffic signal to accommodate the required improvements at the intersection of Wilmot Road and Fifth Street.

      7. The owner/developer shall construct a six (6) foot wide sidewalk along the entire frontage of Wilmot Road and Fifth Street.

      8. A drainage report shall be submitted for review and approval, including retention/detention calculations/requirements.

      9. Hydraulic analysis shall be submitted for review and approval in order to evaluate the capacity of the channel along the west property line. The owner/developer shall dedicate any additional drainage easement required to convey the 100-year discharges arriving at and exiting the site. An additional twenty (20) foot wide access and maintenance easement shall be dedicated along the east bank of the channel.

      10. No walls shall obstruct the flow in the channel or the access/maintenance easement.

      11. Water harvesting techniques shall be utilized by conveying rooftop, parking area access lane (PAAL), and parking area drainage to designated water harvesting areas.

      12. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls adjacent to the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials.

      13. Buildings shall be southwestern in design utilizing earth tone colors. All building elevations shall be equal in the amount of architectural detailing. The applicant shall contact all property owners within 300 feet, and neighborhood associations within one (1) mile of the site, for review of building architectural design and colors (including placement of west facing balconies and nonclerestory windows), and submit minutes of the meeting as part of the development plan review process.

      14. All outdoor lighting shall be directed down and away from residential parcels and public roadways and be as low in elevation as possible.

      15. All dumpsters and loading spaces shall be placed at least fifty (50) feet from residentially zoned or developed property.

      16. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

        Two (2) written approvals and two (2) protests have been received. One protest is within the 150 foot area, representing a 1.5 percent protest by area to the south, less than one percent protest to the west, and zero percent protest to the north and east.

        A simple majority vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.

        6. ZONING: (C9-99-23) OUTPOST GROUP – PIMA STREET, RX-1 TO R-1, ORDINANCE ADOPTION

          (a) Report from City Manager SEPT18-00-540 WII

          (b) Request to rezone property located on the southeast corner of Pima Street and Maguire Avenue, from RX-1 to R-1. Applicant: Outpost Group. The development plan proposes a ten (10) lot single-family subdivision on 3.26 acres utilizing the Residential Cluster Project (RCP) provisions of the Land Use Code (LUC) for a density of 3.0 units per acre. The Development Services Department reports that all conditions of rezoning have been met. The Planning Director recommends adoption of the ordinance presented rezoning the property from RX-1 to R-1. The City Manager recommends adoption of the ordinance presented rezoning the property from RX-1 to R-1 zoning.

          (c) Ordinance No. 9459 relating to zoning: Amending zoning district boundaries in the area located on the southeast corner of Pima Street and Maguire Avenue in Case C9-99-23, Outpost Group – Pima Street, RX-1 to R-1 (Ward 2).

        Nine (9) written approvals and one (1) written protest have been received for this case. None of the protests are located within the 150 foot notice area. This results in a zero percent protest.

        A simple majority vote will be necessary to adopt the ordinance presented.

        7. ZONING: (C9-99-07) AAA AUTO RENTALS – GRANT ROAD, R-2 TO C-2, REACTIVATION AND RETRO-ACTIVE ONE-YEAR TIME EXTENSION

          (a) Report from City Manager SEPT18-00-545 WVI

          (b) Request for a one-year time extension for property located approximately 140 feet south of Grant Road and approximately 385 feet east of County Club Road. Applicant: Wayne Swan of Intertech Architectural Interiors, on behalf of the property owner, 3150 East Grant LLC. The original request was to rezone approximately 0.5 acres from R-2 to C-2 for expansion of an existing auto sales business at 3150 East Grant Road and the addition of a five (5) bay auto repair facility. The original one-year authorization expired June 7, 2000. Given the circumstances surrounding approval of the original rezoning request, in which the GAAP steering committee supported the proposed use but did not include policy direction that was consistent with that position in draft GAAP presented to Mayor and Council, the Planning Department recommends this item be scheduled for a new public hearing before Mayor and Council to allow an opportunity for an update of the discussions that occurred prior to authorization of the rezoning. The City Manager recommends the Mayor and Council set this item for public hearing to consider reactivation of the rezoning case and a retroactive one-year time extension request.

      There are four (4) written approvals and seven (7) written protests. Six (6) of the protests are located within the 150 foot notification area resulting in a protest by area of 9.9 percent to the west, 71.8 percent to the east, 1.4 percent to the north, and 10.6 percent to the south. The protests generally allude to an increase in traffic, noise, and environmental concerns.

      A simple majority vote of the Mayor and Council will be necessary for reactivation of the rezoning, however, a ¾ majority vote will be necessary to adopt an ordinance authorizing a retroactive one-year time extension.

      8. ZONING: (C9-99-25) CHICAGO TITLE TRUST 12151 – ALVERNON WAY, I-1 TO R-1, ZONING EXAMINER'S REPORT (CONTINUED FROM THE MEETINGS OF AUGUST 7, 2000 AND SEPTEMBER 5, 2000)

        (a) Report from City Manager SEPT18-00-547 WV

        (b) Report from Zoning Examiner dated July 28, 2000.

        (c) Request to rezone approximately 16.35 acres of property located on the east side of Alvernon Way approximately 1,275 feet north of Valencia Road, from I-1 to R-1. Applicant: Mr. Michael Grassinger of the Planning Center, on behalf of the property owner, Chicago Title Trust 12151. The preliminary development plan is for a fifty-six (56) lot single-family manufactured housing subdivision using the Residential Cluster Project (RCP) provisions of the Land Use Code for a density of 3.4 units per acre. The Planning Department and Zoning Examiner recommend approval of R-1 zoning, subject to certain conditions. The City Manager recommends approval of R-1 zoning, subject to the following conditions.

        1. A subdivision plat, in substantial compliance with the Preliminary Development Plan and Design Compatibility Report is to be submitted for review and approval in accordance with Section 4.1.1 of the LUC, including, but not limited to:

          1. Structure heights shall be limited to eighteen (18) feet.

          2. At least one direct access point to Alvernon Way (other than Antrim Loop Road) shall be provided from the lots south of Earp Wash.

          3. At least one pedestrian connection between the pedestrian trail along Earp Wash and the streets south of Earp Wash.

          4. The building setback requirements from Earp Wash shall be twenty-five (25) feet based on a 100-year flood discharge of 625 cfs.

        2. The owner/developer shall dedicate, or verify the existence of, right-of-way for Alvernon Way as required per the Major Streets and Routes Plan.

        3. The owner/developer shall construct acceleration/deceleration lanes (one additional twelve (12) foot vehicular lane and a five (5) foot bike lane) to match the future Major Streets and Routes Plan cross section. An in-lieu contribution to an escrow account shall be provided for the future completion of the seventeen (17) feet of pavement along the entire frontage of the rezoning site, if it is not completely developed as part of this project.

        4. The owner/developer shall construct a six (6) foot wide sidewalk along Alvernon Way, in a location to accommodate the future widening of Alvernon Way.

        5. The owner/developer shall dedicate, or verify the dedication of, the Earp Wash channel and twenty-five (25) feet on both sides of the bank.

        6. A drainage report shall be submitted for review and approval. The report shall include detention/retention calculations with compliance of WASH Ordinance requirements. Additional drainage easements may be required to accept offsite runoff and convey it across lots to its logical point of discharge into the Earp Wash.

        7. A regional detention basin is proposed for construction at the northwest corner of this development. The owner/developer may be required to contribute a portion of the cost of construction of this facility.

        8. Water harvesting is encouraged by directing roof drainage to landscaped areas, however, lot to lot drainage shall not be permitted.

        9. Earp Wash improvements shall provide a continuous on-site pedestrian link/trail and connect by means of an on-site common area adjacent to the Antrim Loop Road Bridge, including a pedestrian crosswalk across Antrim Loop Road to guarantee a continuous pedestrian link-train with the adjacent subdivision to the east.

        10. A note shall be provided on the tentative and final plat disclosing that adjacent parcels to the north and across Antrim Loop Road to the south are currently zoned and approved for industrial uses.

        11. A minimum five (5) foot high decorative masonry wall and a ten (10) foot wide landscape buffer with canopy trees shall be provided adjacent to Antrim Loop Road and along the north property line.

        12. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls visible from the public right-of-way shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. In addition, any continuous wall greater than 75 feet in length and 3 feet in height shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.

        13. An on-the-ground survey by a qualified archeologist shall be performed before any ground modification occurs, and if any remains are found, a data recovery program approved by the Arizona State Museum shall be performed.

        14. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

        15. All areas identified as undisturbed open space shall be fenced off and protected prior to any on-site development activity.

        16. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.

        17. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.

        18. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.

      Two (2) written approvals and four (4) written protests have been received. One protest is within the 150 foot notification area. The protest alludes to the general incompatibility of uses and results in a protest by area of 91 percent to the south and zero (0) percent to the north, east, and west.

      A simple majority vote of the Mayor and Council will be necessary to authorize the rezoning, however, a ¾ majority vote will be required to adopt an ordinance once the conditions of rezoning have been met.
