4. PRE-ANNEXATION AND DEVELOPMENT AGREEMENT: WITH NEW WORLD HOMES IN CONNECTION WITH THE PROPOSED ALVERNON/ALVORD ANNEXATION DISTRICT

(b) Resolution No. 17618 relating to annexation; authorizing and approving the execution of a pre-annexation and development agreement between the City of Tucson and New World Homes, Inc.

5. SCENIC CORRIDOR ZONE: (SCZ 97-04) ON THE BORDER, 15 WEST RIVER ROAD

(a) Report from City Manager APRIL21-97-243 WIII

(b) An appeal of the Planning Director’s decision of March 4, 1997, denying the request for the use of murals and neon on the proposed restaurant on the exterior sides visible from a Scenic Corridor. The applicant is Collins/Piña Consulting Engineers, Inc., representing the property owner, Brinker International.

The Planning Director’s decision was based upon the applicable provisions of the Land Use Code. As required in an appeal, the Planning Director’s decision was reviewed by the Development Review Board which came to the conclusion that the colors of the murals and neon are appropriate in this case.

The City Manager recommends that the Mayor and Council uphold the Planning Director’s decision under provision 5.4.4.6.D of the Land Use Code. However, if the applicant submits a design for the mural on the wall most visible from River Road which incorporates colors which are more muted and earth tone, the recommendation is to reverse the decision as it applies to the murals.

6. ZONING: (Co9-95-15) FIRST AMERICAN TITLE INSURANCE #8025 - TANQUE VERDE ROAD, SR TO R-1 (PARTIAL ORDINANCE)

(a) Report from City Manager APRIL21-97-251 WII

(b) Ordinance No. 8863 relating to zoning: Amending zoning district boundaries in the vicinity of the north side of Tanque Verde Road, approximately 800 feet east of Sabino Canyon Road, from SR to R-1.

The City Manager recommends that the subject ordinance be adopted for the R-1 portion of the rezoning case.

This rezoning case was originally filed with Pima County on April 5, 1995. The Board of Supervisors took no action on the request due to the annexation of the site by Ordinance No. 8532 on July 10, 1995. The Pima County Planning Department has advised that, prior to the Pima County Planning and Zoning Commission public hearing, no protests were filed on this case.

A simple majority vote will be necessary to adopt the subject ordinance.
