Homeowners Associations
• HOAs are legal corporations whose elected officers have corporate responsibility. HOAs usually have dues or assessments to maintain the common property;
• HOAs have CC&Rs that regulate the use of the property;
• HOAs may also have rules and regulations imposed by the homeowners which govern the appearance of the property and these are enforced by the officers or management company;
• There are some Arizona State laws that govern HOAs. (There are no City of Tucson laws.);
• If a caller is having trouble with an HOA, they should contact their HOA President to resolve their problem. A private attorney may be necessary if the problem is not resolved individually.
Neighborhood Associations
• Neighborhood Associations are groups of people who come together for a common purpose;
• The Department of Neighborhood Resources provides services (mailings, meeting space, and clean-up assistance) to neighborhood associations that go through a registration process with the City;
• An HOA may apply to become a City Neighborhood Association as long as it meets the criteria set out by the Mayor and Council for registered neighborhood associations, which is implemented by the Department of Neighborhood Resources.
