Rate and Fee Changes

The new rates and fees take effect July 1, 2026. The City of Tucson Mayor and Council approved the proposed rate and fee changes at the May 19, 2026, public hearing.

In 2025, Willdan Financial Services completed a comprehensive User Fee Study to evaluate the full cost of services, reviewed peer city practices, and developed recommendations to align fees with the cost or value of services provided.

Fees recommended in the Willdan Study included:

  • Revising Right-of-Way permit and staff review fees to fully recover costs;
  • Loss of Use (LoU) fees, which apply when public or private activities restrict public use of the ROW, such as lane, street, intersection, bike lane, sidewalk, or bus stop closures; and,
  • Loss of Value (LoV) fees, which apply when activities degrade roadway infrastructure, particularly pavement cuts that shorten pavement life.

Right of Way Permit and Staff Review Fees

The proposed structure simplifies the current fee schedule by replacing numerous flat fees with a standard application fee plus hourly charges based on actual staff time. This approach aligns fees with the full cost of service and reduces the total number of fees from 37 to 23.

Loss of Value (LoV) Fee

DTM’s proposed Loss of Value fees address pavement degradation caused by cuts needed for ROW work. Fees scale based on pavement cut size and pavement age, with higher fees for newer pavement. DTM is implementing pavement degradation fees based on the age of pavement, and is phasing them in over three years. (First year, fees charged at 33%; second year, at 66%; third year, at 100%.)

Fees will be implemented as follows:

All cuts to pavement on arterial and collector streets aged 60 months or less (≤ 5 years), and all cuts to pavement on local streets aged 36 months or less (≤ 3 years) will be subject to moratorium restoration requirements.

  •  All cuts to pavement with an Overall Condition Index (OCI) above 40 will be subject to Loss of Value fees.
  • Cuts to pavement with an OCI of 40 or less, as determined by the most recent DTM condition assessment, shall not be subject to Loss of Value fees.
  • Applicants will be allowed, in certain circumstances and upon recommendation by the City Engineer, to complete pavement restoration that exceeds requirements in lieu of paying associated Loss of Value Fees. The scope and extent of restoration required for fees to be waived shall be determined by the City Engineer or designee, whose decision is final.

Loss of Use (LoU) Fee

The proposed Loss of Use fees place a value on the delays and impacts our community experiences when reductions in roadway capacity are created through these temporary closures.

Fees: Adjustments Based on Input Include:

  • Weekly rates after the first 90 days for projects where 24-hour longer-term closures are required;
  • No charges for: closures three days or less; rolling setups; closures requiring a lane to maintain pedestrian access.
  • Exemptions on the following:
    • City of Tucson and other public agency capital or maintenance projects;
    • Work performed under annual utility maintenance permits.
