Firearm Transfers
FIREARMS ORDERS AND REQUIRED PAPERWORK
Many times, in a domestic violence case, you may be ordered to transfer your firearms to the police and ordered not to possess firearms.
CRIMINAL CASES
As a condition of release while the case is pending, or as a condition of probation.
Those persons ordered by the Court to transfer firearms/ammunition are required to relinquish their firearms/ammunition by the following method:
- Transfer your firearm(s)/ammunition to the nearest Tucson Police Department substation.
TPD Patrol Divisions / Police Substations
- This must be done within 24 hours of the order to transfer.
- All firearms must be unloaded and left in your vehicle when contacting an Officer.
- A Tucson Police officer will provide you with a receipt or case number. You must provide a copy of this along with a copy of the Proof of Transfer to Law Enforcement form to the court as proof of compliance.
- The firearm(s)/ammunition will remain with the Tucson Police Department until an order by the Court is issued releasing the firearms/ammunition.
If you are found guilty of a domestic violence crime and you are sentenced to probation, you will become a prohibited possessor during the term of your probation. Your firearms/ammunition will remain with the Tucson Police Department for the duration of your probation.

PROTECTIVE ORDERS
If you have been served with an Order of Protection that includes orders concerning firearms. To comply with the firearms portion of the Order of Protection, you MUST:
1. Not possess, purchase, or receive any firearms for the duration of the Order of Protection.
2. Transfer any firearms you own or possess at the time of service to the Tucson Police Department immediately upon service of the Order of Protection.
3. Transfer any firearms not in your possession at the time of service to the Tucson Police Department within 24 hours of service of the Order of Protection; and
4. File the completed and signed Affidavit of Firearms Transfer with Tucson City Court within two days of service of the Order of Protection or if the Court is closed, you must file the completed form the next day the Court is open. Return the Form to Tucson City Court, 103 E. Alameda, Room 119.
If you are already prohibited from possessing a firearm, you may want to consult with an attorney for advice. Consulting with an attorney DOES NOT change your obligation to comply with the court order within the ordered time limits. By signing the AFFIDAVIT OF FIREARMS TRANSFER, you are certifying, and under penalty of perjury under the laws of the State of Arizona, that the information you provided in the Affidavit of Firearms Transfer is true and correct.
FAILURE TO COMPLY WITH ALL THE TERMS CONTAINED IN THE ORDER OF PROTECTION COULD RESULT IN CRIMINAL CHARGES FOR VIOLATING A COURT ORDER A.R.S. 13-2810 OR BEING HELD IN CONTEMPT A.R.S. 12-864.
RETURN OF FIREARMS
If you transferred firearms to the Tucson Police Department pursuant to the Order of Protection, once the order is no longer in effect, you may request the firearm through the Tucson Police Department.
Before the firearm can be released, the Tucson Police Department will perform a background check on you, check the ownership of the firearms or make other inquires before releasing any firearms to you. Because of your status or issues related to a particular firearm, it is possible that Tucson Police may not return all or any of the firearms to you.
